Privacy Policy Statement

Fishserve takes your privacy very seriously. We are committed to ensuring we comply with the Privacy Act 2020 and all other relevant privacy legislation and regulatory requirements (Privacy Laws).

Fishserve’s core role is to provide administrative services to the New Zealand commercial fishing industry to support the Fisheries Act 1996. We also develop and offer other software, systems and data services to New Zealand’s commercial seafood sector. Amongst other legislation, Fishserve is subject to the Privacy Act 2020 and the Official Information Act 1982 (OIA). We ensure that all our subsidiaries comply with applicable Privacy Laws.


Scope and Purpose

This privacy policy sets out the basis upon which Fishserve collects, stores, manages and archives personal and other related information of our clients and others external to Fishserve. It does not address the personal information of Fishserve employees which we manage through a separate policy.


Collection of Personal Information

Fishserve collects personal information from registered users of its websites. Some of this information is collected in accordance with the Fisheries (Registers) Regulations 2001 to comply with the Register requirements. We may also collect personal information from contractors, business partners, clients, job candidates and other individuals. This personal information may include your name, email address, contact details, date of birth, occupation, organisation, and forms of identification.

Any or all such personal information will be collected directly from you when:

  • You become a registered user of the website(s);

  • You subscribe to Fishserve subscription services;

  • You give feedback;

  • You lodge a complaint;

  • You make an OIA request; and/or

  • You have provided us with your personal information, such as for applying for a position at Fishserve or when we contract with you.

  • It is needed for Fishserve to carry out contracted services to your organisation.


Use of Personal Information

We will only process your personal information for the purposes which you have consented, which may include requirements set out in the Fisheries Act 1996.

We will only use your personal information for the purpose for which it was collected, or as permitted by law.


Disclosure of Personal Information

We will only share personal information with other companies or individuals in the following limited circumstances:

  • to the Ministry of Primary Industries in order to meet the requirements of the Fisheries Act 1996;

  • for (public) Register requests, as defined in the Fisheries Act 1996;

  • where Fishserve has your express consent;

  • to comply with law in New Zealand.


Management of Personal Information

Fishserve takes the security of your personal information seriously. We maintain robust information security management processes and confidentiality protocols to help ensure that it is protected against misuse, loss, and unauthorised access, use, modification or disclosure. We retain the information we hold in accordance with our statutory obligations and for the period that we lawfully need to keep it. We take reasonable steps to destroy or de-identify personal information that is not necessary for us to keep.

We use the TLS encryption protocol for secure communication of Fishserve webpages over the internet. If you are required to choose a password for access to a Fishserve website or subscription service, you are responsible for keeping this password secure and confidential.

We use accredited providers to store the personal information we collect. We ensure any such provider we use has appropriate security measures in place to protect your personal information.


Use of Cookies

Cookies are small text files that are placed on your computer(s) or other device(s) by websites you visit. They are widely used to help users navigate websites easily, improve the functionality of sites, and provide site owners with information about site traffic. We use cookies to store your preferences, record session information, analyse how the website is used, and ensure that particular features of the website work. Most cookies we use on the website collect information about how visitors use the website. You can disable cookies in your web browser settings and/or delete them from your computer(s) and/or device(s). While you do not need to have cookies turned on to use the website, some online services, features or functions of the website may not function properly if cookies are disabled.

In addition to cookies, we use Google Analytics, a web analytics service provided by Google LLC (Google), to analyse how visitors use the website. This service collects and analyses specific information such as IP addresses, device and software identifiers, referring and exit sites, and site behaviour and use. Fishserve uses Google Analytics to collect and process statistical information about visits to the website, but the data we collect through this service is aggregated and anonymous. Your Rights and Choices

You have the right to ask for a copy of any personal information we hold about you, and to request for it to be corrected if you believe it is incorrect.

Please contact us if you have any concerns relating to the handling of your personal information by us. You can also refer the matter to the Privacy Commissioner or, where appropriate, the Ombudsman.

Please be aware that we may need you to provide evidence of your identity should you make a request for access and/or correction of personal information to us.


Changes to our Privacy Policy

We may make changes to this policy from time to time to ensure it aligns with how our company operates, and that it continues to comply with all current laws and regulations. Any such changes will be noted on this page and we encourage you to visit this page regularly to check for updates. We may also take additional steps to bring the changes to your attention, including notifying you directly. We will update you of any material changes as required by law.
